To register a trademark, you must submit an application to the Department of Industry (DOI) along with a specimen of the trademark, a list of goods/services, tax clearance, and registration documents of the applying entity. The DOI conducts a search and publishes the mark in its gazette. If no opposition is filed within 90 days, the registration certificate is issued.
Nepal follows the principle of territoriality, meaning foreign trademarks must be registered locally at the Department of Industry (DOI) to receive full legal protection. However, Paris Convention priorities can be claimed, and well-known international marks can be protected against bad-faith local registrations through opposition hearings.
